STATE REPRESENTATIVE HON. DIANA FESSLER DOCUMENTS COLLECTION

 

INTRODUCTION

 

The State Representative Hon. Diana Fessler Documents Collection was accessioned into the Piqua Public Library Archives and Special Collections in May 2009.  The collection consists of a series of responses to queries posed by Rep. Fessler or her office to the Ohio Legislative Services Commission.  These queries cover a wide range of topics and are consistent with the subjects under discussion and legislative action in the Ohio House of Representatives in the years 2000 to 2008.

 

The documents are housed in a single 1215 Gaylord Box containing 87 files. These documents are a matter of public record and there are no restrictions on the use of these materials.

HISTORY

 

Ms. Diana Fessler is a resident of Bethel Township, Miami County, Ohio.  She is married and the mother of six children.  Ms. Fessler is or has been involved in a number of associations including the United Conservatives of Ohio, Education Writers Association, the Ohio Rountable Executive Committee, Citizens for Community Values, the Troy, Tipp City, Piqua and Darke County Chambers of Commerce and the Miami Farm Bureau.   In addition she is a member of the Miami County Republican Central Committee and the Miami County Republican Women’s Club.

From 1994-2000 Ms. Fessler was a member of the Ohio State Board of Education representing the Third District.  In 2000 she was elected to the Ohio House of Representatives from the 79th House District representing Miami and parts of Darke County.  Rep. Fessler served in the Ohio House of Representatives for four terms.  Term limit legislation ended her service in 2008.

This collection is a gathering of responses to questions posed by Rep. Fessler to the Ohio Legislative Service Commission for research.  The responses to these queries helped Rep. Fessler to form legislation in a variety of areas.

  1. Response to question about recodifying Chapter 2151 of the Revised Code especially section 2151.421, which deals with child abuse reporting.  Included in this response is a history of the creation of the Revised Code and statements of the pros and cons of recodification.

  3. Response to request for information regarding a constituent’s request that the Medicaid program provide a motorized wheelchair for use in a nursing facility.

 

            7          September 2001

  1. Response to request for information on the effect of eliminating all property taxes and replacing them with a state sales tax.  To generate the same revenue the state sales tax would need to go from 5 percent to 13.7 percent.
  2. Draft bill addressing concerns raised by the Union Township trustees regarding their zoning authority for cellular towers in unincorporated territory.
  3. Response to request for information on law regulating the priority of liens against real property and mortgage releases.

 

            8          October 2001

  1. Response to request for information on whether Ohio law prohibits a student from bullying another student.  [In 2001 there was no statute that referred specifically to bullying.]
  2. Letter concerning the draft of a bill that would limit the use of police pursuits.  This is a follow-up to the letters in file 5 and file 6.
  3. Response to request for information on election costs for village council.
  4. Draft of an amendment to a bill concerning county emergency management grants.

 

            9          November 2001

  1. LSC-124-1383 – Bill Analysis and proposal.  Bill requires the Ohio Emergency Management Agency to issue grants of specified amounts to each countywide and county emergency management agency for the purposes of disaster preparedness and civil defense.
  2. House Bill 430 – Is the above legislation as introduced.
  3. Response to request for an estimate of the grants each county would be eligible for under House Bill 430.

 

            10        December 2001 - Response to request for information on the

authority of park districts and a board of park

commissioners to place a tax levy on the ballot since

its members are not elected.

  1. Letter concerning a bill draft requested by Rep. Fessler to require replacement levy ballots and associated election notices to indicate more fully the effects of replacement levies.
  2. Response to request for information on a perception that police and paramedics must both respond to a 911 call.  No such requirement exists.

 

            12        February 2002

  1. Response to request for information on what aid is available to assist a family in making its home handicap accessible for one of its children if the family cannot afford to make the modifications.
  2. Response to request for information on laws requiring municipalities to provide handicapped accessible sidewalks.
  3. Response to request for the Dayton Daily News series on foster care and information on independent living services for youth.
  4. Response to request for information on the amount of money spent for independent living services and a breakdown of spending by age group, with and without the Medicaid component and a determination of the average cost per participant.
  5. Memorandum covering cost estimates for allowing the State Children’s health Insurance Program to cover individuals from conception through eighteen years old.  The purpose of the memorandum is to report the cost estimate for H.B. 517.

  3. Letter concerning the draft of a bill that would limit the use of police pursuits.  This is a follow-up to the letters in files 5, 6 and 8.
  4. Response to an inquiry by a constituent who asked about the legal basis for his pay being taxed by more than one municipal corporation.
  5. Response to request for information on a provision of federal law that may cause retirees of Ohio’s public pensions systems and their spouses to have their Social Security benefits reduced.

feasibility of requiring the Registrar of Motor Vehicles and

deputy registrars to ask each person applying for or renewing a

motor vehicle registration whether the person wishes to make a

voluntary contribution that would be used to support volunteer

emergency medical services.

 

            16        July 2002

  1. Response to request for information on the history of Revised Code 2106.01.  This section pertains to the right of a surviving spouse to elect whether to take under the will or under the Intestate Succession Law.
  2. Response to request for information on the funding and fund raising activity of The Coalition for Equity and Adequacy of School Funding.
  3. Response to request for information on the Educational Management Information System and the contract between the Ohio Department of Education and PwC Consulting for the assignment of the Statewide Student Identification number.

flexibility of the local court system under Ohio law in

  2. Response to request for information about county zoning authority to regulate the size of buildings.
  3. Response to request for research of the Revised Code definition of “stepparent” and the number of times “stepparent” is used in Ohio law.

  1. Response to request for information on the provisions of Am. Sub. H.B. 12 of the 125th General Assembly concerning the issuance of a license to carry a concealed handgun and its impact upon churches and church parking lots.

  4. Response to request for clarification regarding H.B. 402’s effect on inheritance and grandparents’ companionship and visitation rights, and whether the bill requires parental consent.

  1. Response to request for information about the appropriate rules for flying the United States flag at half-staff.
  2. Response to request for information regarding the four percent operational feel charged by the Department of Mental Retardation and Developmental Disabilities for each approved Community Alternative Funding System program claim that is paid.

  4. Response to request for a six-year review of funding for vocational rehabilitation at the state and federal levels.  The request included an overview of the funding as well as specifics on the sources of funding.

            37        July 2004

  1. Response to request for information concerning child support orders, the interdependence of visitation rights and child support obligations, and the penalties for failure to comply with child support orders.
